West Yorkshire Combined Authority and Home Energy Loan Privacy Notice

The following updates to this privacy notice have been made to provide further clarity:

  • Explicitly stating the lawful basis for processing for evaluation purposes
  • Who to contact for Data Subject Rights request if you consented to information shared by Solar Together

For the purposes of the UK General Data Protection Regulation (UK GDPR), the West Yorkshire Combined Authority and Lendology are both independent controllers of the personal data you provide. Lendology is a FCA regulated organisation that has been appointed by the West Yorkshire Combined Authority (‘the Combined Authority’, ‘we’, ‘us’), to deliver a low interest loan scheme to support homeowners and private landlords across West Yorkshire in retrofitting their homes. This is part of a wider domestic retrofit programme from the Combined Authority to support people to improve the energy efficiency of their homes. The Combined Authority is registered with the Information Commissioner’s Office with registration number ZA051694. Lendology is registered with the with the Information Commissioner’s Office with registration number Z8200608.

Lendology will collect your data and will process it for the purpose of managing and administering the loan. For further information on how Lendology handles your personal data, please see Lendology’ s privacy policy.

Where you have opted in for referral to the Combined Authority’s other schemes under the domestic retrofit programme, Lendology will share your data with the Combined Authority and its appointed delivery partners of those schemes. Lendology will share some of your information with the Combined Authority, for the purposes of monitoring (regular reporting) and evaluation. The Combined Authority will share some of your information with an appointed third-party evaluator to evaluate the programme and understand the effectiveness of it to inform future policy and development of programmes. We will do this under the lawful basis of ‘public task’ as set out below.

We will not share your information with any organisation, or third party save for those mentioned above except in certain circumstances, which are:

  1. if we have a legal obligation to do so or if we are required or requested to do so by a competent authority such as the police or a court;
  2. if we need to use or disclose your information to obtain legal advice or in connection with legal proceedings;
  3. if we need to share your information to protect your vital interests if you are unable to give us consent or it is unreasonable for us to ask for your consent in the circumstances (e.g. if you are injured).

The Combined Authority will retain your information until the end of the One Stop Shop service. One Stop Shop is an information and advice service under the domestic retrofit programme. This is so that we can provide continued support to residents via the One Stop Shop on improvements to home energy efficiency.

This is in accordance with our information retention policy and on the expiration of such period we will safely delete it. Each appointed delivery partner will only retain your information for the duration that it is necessary to the purposes of the scheme and the purposes outlined above.

Information provided to the Combined Authority will be processed under Article 6(1)(e) of the UK GDPR which states that processing is necessary for the purposes of a task carried out in the public interest or in the exercise of official authority vested in the controller and where applicable, Article 6(1)(a) of the UK GDPR which states that the data subject has given consent to the processing of their personal data for one or more specified purposes

As a data subject you have a number of rights under the UK GDPR. These include the right to access the information which we hold about you. In some cases you may have a right to have your personal data rectified, erased or restricted, and to object to certain use of your data. If you have given consent to your personal information being shared from Solar Together, in the first instance to exercise your rights please contact westyorkshire@solartogether.co.uk

This would not affect the legality of what we do with your personal data before you make such a request and would not stop us from continuing to use your data to the extent that we do not require your consent. It would stop us from further using data for purposes which require your consent (e.g. marketing).
